Child Adoption is not Illegal in Pakistan

Pakistan has no Child Adoption Law

The adoption of children in Pakistan is not governed by any law. When you decide to adopt from a family or orphanage, you should hire a lawyer. On your behalf, the Lawyer will file an application with the Family Court. Four to eight hearing dates are scheduled during the legal adoption process over the course of six to eight weeks. Keep this in mind when adopting a child in Pakistan

  • The adoptive parents do not pass down any inheritance to their adopted children.
  • Islam prohibits changing the names of adoptive parents and guardians but allows changing the names of adoptive parents.
  • Muslim minors cannot be adopted by Christians or other religions. 
  • Adoption & Guardianship deeds must be executed.
  • In an adoption, the child’s maintenance rights are transferred to the adoptive parents, who are then responsible for supporting him or her.
  • Minors traveling abroad require the approval of their guardianship court.

Child's Adoption Process

Medical and written reports are required from adoptive parents. Which is known as Form ICA, having the following stats:

 

  • Name of the child
  • Child’s date of birth
  • Place of birth
  • Adopt through the Family Court
  • Name and address of the biological parents
  • Couples must have been married for at least three years in order to qualify. (Copy of the marriage certificate would be required). 
  • At least 25 years of age is required for prospective adoptive parents.
  • Parents must be able to afford to raise a child.
  • At least one parent must be of Pakistani origin or eligible to obtain a Pakistani NICOP or CNIC.

Two Ways of Adopting a Child:

1-A Child’s Parents or an Orphanage 

It is possible to adopt a child directly from your parents by using a child adoption deed and its declaration by a civil court. The Guardian Court will issue you a Guardian Certificate and Travel Permit if you obtain a declaration decree in your favor. 

2-Child Protection Authority 

Punjab Child Protection Authority or Sindh Child Protection Authority can arrange for adoption, as can a Guardian Court. Infants cannot be placed in unrecognized centers under Pakistani adoption procedures. Child protection centers or recognized centers should handle procedures instead. Your next step is to make your case to him and convince him you are qualified to adopt a child from Pakistan.

Adopting a baby in Pakistan involves filling out a complete profile, which includes the gender and age of the baby, as well as any other requirements. A Pakistani lawyer must prepare a complete file for the application. 

It is also required of the adopter to provide information about occupation, age, religion, income, etc. Adoptions from unapproved centers are not permitted in Pakistan. Only Edhi, SOS Village, and other approved centers in Pakistan provide this service. If you meet the requirements, you can adopt a child from a few government-approved adoption agencies in Pakistan. Your lawyer will issue a certificate of adoption after the entire adoption process has been completed in Pakistan as evidence of your adoption.

The Guardians and Wards Act of 1890

Asian countries are generally credited with establishing guardianship and custody laws with the Guardians and Wards Act of 1890. 

A guardian court considers the minor’s welfare first when granting custody to parents or, more traditionally, grandparents or relatives. Custody is granted to youngsters under this law. Three parties are usually involved in an exceptional family court guardianship or custody proceeding: 

  • A protective parent is one who is there to protect their children.
  • Parents who do not provide protection for their children.
  • This is the minor. 

Guardians and Wards Act, of 1890 outlines parental rights regarding custody in Sections 17 and 25. The rights of “Hizanat” and “Wilayat” fall under this category. “Hizanat” refers to the mother’s custody of minors, while “Wilayat” refers to the father’s custody.
